Definitions.

  • By using our website, or by purchasing anything from this site, you agree to be bound by our terms and conditions.
  • If you are under 18 you cannot purchase goods from us or create an account.
  • “Carrier” refers to anybody contracted by our vendors or ourselves to deliver goods to you.
  • “Our website” is all the computing hardware and software that makes up our site.
  • “Goods” refers to products we all selling via our website.
  • “Content” refers to any information on our site, published by us or anybody else with our consent.
  • “Us” or “we” refers to JAK Fine Art Printing.
  • “Seller”, “Artist” or “Vendor” refers to anyone selling on our website.
  • “You” refers to anyone using the website to view or purchase goods.

Prices & Payments.

  • You must be at least 18 years old to make a purchase through our website.
  • The full price of your order must be paid before we can dispatch any part of it.
  • All prices and payments are in pounds sterling £.
  • JAK Fine Art Printing is not VAT registered. VAT is not added, or included, in our prices.
  • We use PayPal as our online payment provider. PayPal offers the buyer the very highest degree of protection. Your card details are never known to us, and your sensitive card details are not stored on our system.
  • You do not need to have an account with us, or PayPal, in order to make a payment.

Our agreement with you.

  • Your order will be accepted by confirmation email which will also confirm details of your order. A follow up email will confirm that the goods have been despatched. This is when our contract with you is made.
  • All descriptions of the goods are given by the artist, and may not be accurate. Therefore any such description does not form part of this agreement.
  • If any goods you order are unavailable you may be offered alternatives prior to us despatching your order. You can: 1) Accept the alternative. 2) Remove the item from your order. 3) Cancel the order.
  • If you are owed money by us for this, or any other reason, the amount will be refunded via PayPal to the account used to make the purchase.
  • By purchasing through our website, customers are entering into a binding contract under UK law and are agreeing to our terms and conditions and privacy policy.

Your Information.

In order for us to complete your purchase order, and deliver it to you. You must supply us with accurate and up to date information. Please refer to our Privacy Policy on how we use your personal information.

Cancelling an order.

  • In compliance with the Consumer Contracts Regulations, you have the right to cancel an order, without giving a reason, 14 days after you have received the goods (when the delivery has been signed for).
  • Please contact the seller within this 14 day period to cancel the order.
  • The order must be returned within 14 days of the cancellation date.
  • The order must be returned to the seller address, in perfect condition so that the item can be resold. Refunds cannot be offered for goods returned damaged and you are responsible for ensuring the goods are sufficiently packaged to prevent damage.
  • You are responsible for the cost of returning the order.
  • A refund for your order, excluding shipping costs, will be paid (via PayPal) within 14 days of receipt of the goods.
  • We cannot accept cancellations if the item ordered has been personalised in any way.

Damages in transit.

If goods arrive damaged, please contact us with three days of receipt (signed for) via email. The email must include photographs of the damaged item and the damaged packaging. We will resolve the issue by:

  • Replace the damaged goods.
  • Refund the costs, including shipping, of the damaged item.

Links.

Our website may contain links to other websites. Use of these links is at your discretion and you agree that we are not responsible for the availability of these links. You also agree that we are not liable for any content, information, goods or services available or supplied by these sites.

Use of our website.

By using our website you agree and acknowledge that:

  • We may make changes to our website at anytime without prior notice.
  • We reserve the right to refuse an order without having to give a reason.
  • You will not violate any aspect of the website security or attempt to modify, copy or damage any part of our website or software used on it.
  • You will not copy, reproduce or modify any of the content.
  • Our liability in any claim against us is limited to the value of the goods purchased.

Human error.

Whilst every effort is taken to ensure that the artworks listed on our site are accurately described and priced, human errors may sometimes occur. Should a mistake be made, we will contact you and you can:

  • Cancel the order and receive a full refund (including shipping) for the payment received by us.
  • Accept an alternative item offered by the artist.
  • If prices are incorrect (to low), we reserve the right to cancel the order. Or you can agree to pay the difference.
  • If prices are incorrect (to high), we will refund the difference.

Copyright.

Title and ownership rights remain the sole property of us or the artist selling on this site. You may not copy, reproduce or exploit in any way the contents of this site.

Rights of third parties.

Nothing in this agreement or on our website shall confer on any third party any benefit under the provision of the Contracts (Rights of Third Parties) Act 2010.

Indemnity.

You agree to indemnify us against any claim, including any fees, made by a third party arising in any way from your use of our website or any infringement by you, or any person using your computer, of any intellectual property or other rights of any person.

Force Majeure.

We will not be liable for a breach of our obligations arising from something beyond our control. For example, postal strikes, severe weather, equipment breakdowns, illness or bereavement.

Governing Law.

This agreement shall be governed and construed in accordance with the laws of England only.
